收費標準、條款及細則

CoolJobz 的錄取方案服務以「成果」收費。客戶 在成功錄取人選以後,支付 CoolJobz 費用,額度為該職位一個月薪金。*最低收費為港幣$5,000


引言及說明
1. 本合約是 CoolJobz 與所屬網站、平台,及網路服務提供人才招募解決方案服務時所使用。
2. 本合約所有名詞解釋、定義等皆與 CoolJobz 的「個人用戶協議」、「隱私權政策」及一切相關文件相同。
3. 客戶 必須先有負責招募的聯絡人註冊成為 CoolJobz 服務的「會員」,才能進一步註冊企業帳號。
4. 除 客戶 與 CoolJobz 以書面另外所達成的協議以外,一切資料認定皆以 CoolJobz 網站、系統與延伸服務上的紀錄為準。
5. CoolJobz 提供「錄取方案(Hire Plan)」徵才方案,資訊公開透明。客戶 透過 CoolJobz 服務發佈職缺時,最底限度必須公開該職位的薪金範圍或薪金下限的資訊。
說明:「信任」為 CoolJobz 所相信的核心價值,而「資訊透明」能夠給予人才對僱主充份的信任。當 僱主 所提供的資訊愈加透明、完整、準確,便能透過 CoolJobz 更有效率地錄取合適的人選。
 
錄取方案(Hire Plan)
6. 錄取方案為 CoolJobz 所提供的標準化服務,如需以下內容以外的服務項目,例如客製化合約、延長保障期限、修改徵才廣告等等,請 客戶 與我們客戶服務人員聯絡。
 
7 錄取方案的規範

7.1. CoolJobz 的錄取方案服務以「成果」收費。客戶 在成功錄取人選以後,支付 CoolJobz 費用,額度為該職位一個月薪金。

7.2. 錄取方案的最低收費為港幣$5,000,如客戶所錄取人選的一個月薪金低於港幣$5,000,亦需支付最低收費額度$5,000。

7.3. 客戶 須在該名錄取人選開始工作後的30個日曆天內支付該筆費用。
7.4. CoolJobz 保障該名錄取人選最少任滿90個日曆天。
7.5. 如前 90 個日曆天內,該人選自行離職,則自離職日起算的 90 個日曆天內,CoolJobz 須再補充一名替代人選。
7.6. 承上,該名替代人選自任職起同樣有 90 個日曆天的保障期。與原本人選的薪金如有差異,則服務費用亦多退少補。
7.7. 承上,如 CoolJobz 無法在期限內補充替代人選,或 客戶 已自其他管道錄取合適人選,或已無該人選需求(但 客戶 需提出無該人選需求之合理說明),則 CoolJobz 須按比例退費,退費以未完成之任期來計算。
7.8. 特別強調,如該人選在前 90 個日曆天內因工作專業表現等問題,無法過試用期而被 客戶 解任,則不在 CoolJobz 的保障範圍之內。
7.9. 使用本方案的 客戶 張貼職缺無須支付張貼費用。
 
8. 錄取方案的內容
8.1. 客戶 在 CoolJobz 系統上選擇錄取方案服務以後,CoolJobz 將有專業顧問與 客戶 聯繫,提供協助。
8.2. 客戶 必須將要招募的工作資訊張貼於 CoolJobz 網站及所有延伸之網路平台,並保證所提供資訊正確無誤。若 客戶 提供之資訊有誤而造成 CoolJobz 之損害,客戶 應對 CoolJobz 負擔損害賠償責任;若因此而造成求職者之損害,客戶 應自行負責,概與 CoolJobzs 無涉。
8.3. CoolJobz 將依本身專業判斷,視 客戶 招募需求之不同,提供目標行銷、文字或影音專訪、線上或線下活動推廣、社群推薦等方式,協助 客戶 徵才。
8.4. CoolJobz 將於社群網路分享並推廣 客戶 之企業和職缺資訊,包括且不限於在 Facebook、Google+、LinkedIn、Youtube、Instagram、WeChat 等,以及 客戶 有特殊需求之網站或社群。
8.5. 客戶 得以 CoolJobz 之專業顧問建議提供招聘用的必要相關資訊,包括但不限於影片、圖片、錄音、文字訊息,以及現職員工、招聘主管或企業創辦人專訪及/或簡歷等素材。
8.6. 前項所提之素材不包含 客戶 因商務考量而必須保密的資訊和材料。包括 客戶 的企業名稱在內,CoolJobz 須獲得僱主以任何可留下紀錄之方式許可,才可公佈該項資訊。如未獲許可擅自公佈,則 客戶 有權立即解除合約。如因此造成 客戶 至或任何損失,CoolJobz 當負一切賠償與法律責任。
8.7. 如 CoolJobz 所提供的招募方案有任何衍生的額外費用,則在取得 客戶 同意,並以任何可留下紀錄的方式佐證之後,雙方議定由哪方負擔該費用,並另行約定付款、憑證、墊款等細節事項。
 
9. 就職的認定
9.1. 在 CoolJobz 服務上確認錄取有以下兩種方式:
A. 客戶 確認:客戶 可以以任何可留下紀錄的方式告知CoolJobz。
B. 求職者回報後 客戶 確認:一旦錄取工作,求職者將可透過電郵 CoolJobz 回報就職,我們的客戶服務員在收取電郵後會向客戶查詢,或以任何可留下紀錄的方式告知。
 
10. 實質薪資的認定
一旦確認錄取,客戶 必須提供薪資資訊,例如僱傭合約、錄取信或薪資單作為佐證,以當作 CoolJobz 收費的依據。如該資訊由求職者提供,也必須獲得 客戶 以任何可留下紀錄形式,回覆確認。
 
11.1 CoolJobz 對於薪金資訊負有保密責任,只能做為收取服務費用的佐證,而不可以用於其他用途。

11.2. 服務費用的計算方式為一個月薪金,如該職位的薪資計算方式為年薪,則直接以該數字 除12個月為 服務費用的數字。

11.3. 如該職位的薪資計算方式為月薪,則直接以入職時每月薪金為服務費用的數字。

11.4 如該職位的薪資計算方式為日薪,則乘以22(每月工作日數)為服務費用的數字。

 

 
12. 付款方式
12.1. 一旦 客戶 向 CoolJobz 確認求職者就職,並告知薪資資訊,CoolJobz 將提供帳單(invoice)及付款所需文件(如發票)。收到帳單以後,客戶 須在15個日曆天內完成付款。
12.2. CoolJobz  現可接受Paypal、銀行轉帳、支票、轉數快等付費方式,客戶 可從中選擇,詳細付款方法將顯示於帳單(invoice)上
12.3. 如有其他衍生費用,例如手續費、匯費、各項相關租稅等,皆由 客戶 自行負擔。
 
13. 道德宣告
13.1. 人才招募的成敗往往決定一家企業的成敗。而企業能夠成功招募到優秀人才,必須基於企業、人才和服務提供者間的互相信任。因此,如有求職者以「不向 CoolJobz 回報就任工作」為條件,要求 客戶 提供任何額外的報酬、獎金或其他形式的利益回饋,CoolJobz 強烈建議 客戶 不要錄取該求職者。如向 CoolJobz 舉報該求職者,CoolJobz 也將負查證之責任;一經查證屬實,即將該求職者列為「排除名單」,告知 CoolJobz 所有的企業 客戶。
13.2. 如 客戶 以「不向 CoolJobz 回報錄取工作」為條件,主動提供求職者任何形式的利益交換,則求職者或推薦人亦有權利舉報該企業。如查證屬實,考量此一行為有違企業徵才時的誠信原則,CoolJobz將在網站上公開 客戶 企業名稱,並列入「不推薦企業」名單。
13.3. 如 客戶 無法在收到帳單後的 30 個日曆天內完成付費,必須以可留下紀錄的形式取得 CoolJobz的同意,雙方並約定付款時間。如 客戶 有刻意拖延,甚至在未取得 CoolJobz 同意下未準時付費的情況,則 CoolJobz 將會在網站上公開企業名稱,並列入「不推薦企業」名單。
13.4. 如 客戶 提供的職缺資訊,與最後錄取之條件不符,尤其當錄取薪資低於招聘職缺薪資區間的最低薪資時,企業 須在 72 小時內主動以書面或可留下記錄的方式提出說明,並取得求職者和推薦人同意的聲明,作為佐證。如未獲得求職者和推薦人的同意,且該情事發生超過三次,CoolJobz 將會在網站上公開 客戶 名稱,並列入「不推薦企業」名單。
 
14. 個資保密
由 CoolJobz 應徵工作的求職者,其履歷、作品集、技術測試結果等所有資料,僅供 客戶 評估該求職者是否錄取使用,客戶 不可用於其他用途。若因此而造成求職者之損害,由 客戶 對求職者負擔損害賠償責任,概與 CoolJobz 無涉。
 
15. 簽核方式
CoolJobz 提供以下方式供 客戶 簽核本合約。客戶 只需擇一採用即可。
A. 直接在 CoolJobz 系統上勾選同意合約。此為 CoolJobz 所建議具備法律效力且最有效率的方式。
B. 下載 CoolJobz 已簽核完成的合約,由 客戶 列印,簽核完成後,發送至CoolJobz電郵。
C. 在 CoolJobz 系統上點選寄送紙本合約,並填入收件地址。CoolJobz 收到要求後將寄送已簽核完成的紙本合約共一式兩份,由 客戶 簽核完成後,將一份紙本寄回到 CoolJobz 備存。
 
16. 合約修改與終止
16.1. 無論選擇任何方案,只要未張貼職缺或職缺關閉,客戶 即無需再負擔任何費用。故絕大部份的情況下,本合約沒有終止的必要。
16.2. 如有需要,CoolJobz 與 客戶 雙方皆具有單方面終止合約之權利。如一方欲終止合約,必須於終止日前一個月內告知對方。並於履行本合約全部義務後,合約方得終止。
16.3. 前項全部義務包括一切款項支付、資訊提供以及資訊關閉等事項。
16.4. 如遇不可抗力之因素,如其中有一方受災難、政治事件、宗教、種族等衝突以致無法履行合約,另一方對他方不負任何法律責任。
16.5. 如 CoolJobz 針對本合約有所修改,將透過系統以及可留下紀錄的方式通知 客戶。如 客戶 不同意修改的內容,一般情況下,只需不再使用 CoolJobz 服務即可。
 
17. 準據法及爭議解決
17.1. 您和 CoolJobz 同意除與法規相左之處以外,如本合約及/或「服務」引發任何爭議,皆以香港相關法規及法務單位為主。
17.2. 如本合約有任何無法履行的部分或條款,雙方均同意應以保留原始目的且又能履行的方式修改本合約條款。如果無法修改,雙方同意移除無法履行的部分,並履行合約中的其餘條款。
17.3.本合約的英文版本及繁體中文版本均具有法律約束效力。如不同版本條文、用詞有所歧異,則以英文版本為主。本合約為雙方最終且完整之合意,有取代磋商過程中所提出之任何口頭或書面上的承諾、理解或其他意思表示之效力,且本合約之條款標題,僅為參考之用,雙方同意標題之內容不能作為解釋本合約之依據。
17.4. 如果CoolJobz 對違約行為未採取法律行動,並不代表 CoolJobz 放棄履行本合約的權利。未經 CoolJobz 的同意,客戶 不得指定或轉讓此合約(或會員身分或服務使用)。然而,客戶 您同意 CoolJobz 得將此合約指定給其相關機構或購買 CoolJobz 的機構。
17.5. 您同意第 24 條所述的地址為提供 CoolJobz 法律通知唯一的方式。

Charges, terms and conditions.

Hire Plan of CoolJobz is charged based on results. After the Client successfully recruits the candidate, it will pay CoolJobz of the expenses and the amount will be one month's salary. *The minimum charge is HK$5,000


Recitals and Explanations
1. This Agreement is to be used when CoolJobz and its website, platform and online service provides solution service to talent recruitment.
2. All explanation and definition of the terms under this Agreement are the same as those in the “User Agreement”, “Privacy Policy” and all relevant documents of CoolJobz.
3. Client must have the contact person responsible for recruitment registered as a member of the CoolJobz service to further register a business account.
4. Save and except for the agreements separately reached by the Client and CoolJobz in writing, all information will be recognized as that recorded on the CoolJobz website, system and extended service.
5. CoolJobz provides "Hire Plan" recruitment plan.
Note: “Trust” is a core value which CoolJobz believes and “transparent information” could allow the talents to sufficiently trust the employer. When the employer provides information as transparent, complete, and accurate, it will be able to recruit a suitable employee more efficiently through CoolJobz.
 
Hire Plan
6. Hire Plan is the standard service provided by CoolJobz, if services other than the below items are needed, such as customized agreement, extension of guarantee period, change to recruiting advertisement, please contact our customer service representatives.
 
7. Hire Plan Stipulations

7.1. Hire Plan of CoolJobz is charged based on results. After the Client successfully recruits the candidate, it will pay CoolJobz of the expenses and the amount will be one month's salary.

7.2. The minimum fee for the Hire Plan is HK$5,000. If the candidate's monthly salary is less than HK$5,000, client also need topay the minimum fee of $5,000.

7.3. The Client needs to pay the fees within thirty (30) calendar days after the offeree starts working.
7.4. CoolJobz guarantees that the offeree will be on the job for 90 calendar days.
7.5. If the offeree resigns within the first 90 calendar days, then within 90 calendar days from the resignation day, CoolJobz needs to supply with a substitute candidate.
7.6. Following the foregoing, such a substitute has a guarantee period of 90 calendar days since commencement as well. In the event the salary is different from that of the original offeree, the service fees will be adjusted accordingly.
7.7. Following the foregoing, if CoolJobz cannot supply with a substitute candidate within the period, or the Client has offered the job to an appropriate candidate through other channels, or if such a demand no longer exists (provided that the Client has to submit a reasonable explanation to the lack of the need for such a candidate), then CoolJobz needs to refund by portion. The refund is calculated based on the uncompleted term.
7.8. Specifically, if such an offeree is disemployed by the Client during the trial period due to work performance within the first 90 calendar days, it will not be within the guaranteed scope of CoolJobz.
7.9. The Client adopting this plan does not need to pay for posting expenses.
 
8. Hire Plan Contents
8.1. After the Client selects Hire Plan on the system ofCoolJobz, a professional consultant of CoolJobz will contact the Client to provide with assistance.
8.2. The Client needs to post the recruiting job information to the CoolJobz website and all extended web platform and guarantee the information provided is correct and without mistakes. If the information provided by the Client is incorrect and causes damages to CoolJobz, the Client shall be liable to CoolJobz for the damages; in the event applicants suffer damages incurred therefrom, the Client shall be liable and CoolJobz will not be involved.
8.3. CoolJobz will, based on its professional judgment and depending on the recruiting needs of the Client, provide target marketing, text or video interview, online or offline promotion, community referral to assist the Client in recruiting.
8.4. CoolJobz will share and promote the Client’s business and job openings information on social networks, including, without limitation, Facebook, Google+, LinkedIn, YouTube, Instagram, and WeChat, as well as other website or network specially required by the Client.
8.5. The Client may, based on advice from professional consultant of CoolJobz, provide information necessary and relating to the recruitment, including, without limitation, videos, pictures, recordings, text messages, and interviews and/or resumes of current employees, hiring manager or business founder.
8.6. The materials mentioned under the preceding section do not include information and materials that need to be kept confidential due to the Client’s business concerns. Including the Client’s company name, CoolJobz needs to obtain the employer’s permit in any recordable form to publish such information. If it is published without permit, the Client is entitled to immediately terminate the Agreement. In the event the Client suffers any damages therefrom, CoolJobz will be liable for all damages and legal responsibilities.
8.7. In the event any additional expenses derive from the recruitment plan provided by CoolJobz, then after obtaining the Client’s consent shown in any recordable form, the parties will agree upon the party bearing such expenses and then separately agree upon the details of payment, certificates, and reimbursement.
 
9. Employment Recognition
9.1. Employment on CoolJobz service may be recognized in the following three ways:
A. Client confirmation: Client may directly confirm the employment by sending us an email or inform it in any recordable form.
B. Client confirmation after the applicant reports: Once employed the job, the applicant may report the employment to CoolJobz, our customer serivce representative will comfirm it with the Client.
 
 
10. Actual Salary Recognition
Once confirmed hired, the Client needs to provide the salary information, such as employment agreement, offer letter or payment slip as evidence as the basis for CoolJobz to charge. If such information is provided by the applicant or referrer, it needs to obtain the Client’s confirmation thereof in any recordable form.
 
11.1 CoolJobz is obliged to keep the foregoing salary information confidential, and such information may only be used as the evidence of charging service fees.

11.2. The service fees will be calculated in the following way: if the salary of the position is listed annually on the system, then it will be divided by 12 and this amount will be the service fees.
11.3. Following the foregoing, if the salary of the position is listed monthly on the system, then this monthly salary will be the service fees.
11.4. Following the foregoing, if the salary of the position is listed daily on the system, then such an amount will multiple with 22 (number of monthly working day) ,



12. Payment Methods

12.1. Once the Client confirms the employment and inform it of the salary information, CoolJobz will provide an invoice and the document required for payment (such as receipt). The client needs to complete the payment within 15 calendar days after receipt of the invoice.
12.2. CoolJobz now accepts two payment methods of Paypal, Bank Transfer, Cheque and Faster Payment System among which the Client may choose therefrom and the details will be shown on the invoice.
12.3. In the event there is any derivative expenses, such as charges, remittance fees, and all relevant taxes, it will be borne by the Client.

13. Ethics Statement
13.1. The success of talent recruitment often detiermines the success of a business. A business could successfully recruit excellent talent based on the mutual trust among the business, talents and service provider. As such, if an applicant or its referrer requests the Client to provide any extra compensation, bonus or benefits in other forms under the condition of “not reporting the employment to  CoolJobz,”  CoolJobz strongly advise the Client not to hire such an applicant. In the event such applicant or referrer is reported to  CoolJobz,  CoolJobz will be responsible for the investigation thereof, and once confirmed to be true, such an applicant or referrer will be listed as “excluded,” and be informed to all of  CoolJobz’ business clients.
13.2. If the Client actively offers benefit to applicant or referrer in any form under the condition of “not reporting the employment to  CoolJobz,” the applicant or referrer is also entitled to report such a business. Once confirmed to be true, considering such a conduct is in violation of integrity of the recruitment, CoolJobz will announce the Client’s name on the website and list it as “not recommended.”
13.3. If the Client cannot complete the payment within 30 calendar days after receipt of invoice, it needs to obtain  CoolJobz consent in recordable form and the parties will agree on a payment day. If the Client intends to delay or does not pay in time without  CoolJobz’ consent, CoolJobz will announce the business name on the website and list it as “not recommended.”
13.4. If the information of the opening provided by the Client is inconsistent with the condition of the final offer, especially where the offered salary is lower than the lowest salary in the recruiting salary range on the system, the Business needs to proactively submit an explanation in writing or other recordable form within 72 hours and obtain the applicant’s and the referrer’s consent statement as evidence. If the applicant’s and the referrer’s consent is not obtained and the same happens for more than three times,  CoolJobz will announce the Client’s name on the website and list it as “not recommended.”
 
 
14. Confidentiality of Personal Information
For applicants answering the post through or referred by CoolJobz, all of their information including resume, portfolio, technical test results will only be provided to the Client to assess whether the applicant is hired or not and the Client may not use the same otherwise. In the event any damages are caused to the applicant, the Client will be liable to the applicant therefor and CoolJobz is not involved.
 
15. Execution
CoolJobz provides the following methods for the Client to sign this Agreement and the Client only needs to adopt one.
A. Directly select agree to the agreement on CoolJobz website. This is recommended by CoolJobz to be legally binding and the most efficient.
B. Download the agreement already executed by CoolJobz and printed by the Client, and scan and send to CoolJobz at cs@cooljobz.com .
C. Ask for hardcopy by sending us your address. CoolJobz will send the executed hard copies in two counterparts after receipt of the request. After the Client executes the same, send a hard copy back to CoolJobz for reference.
 
16. Amendment and Termination
 
16.1. Whichever plan chosen, as long as there is no posting for openings or the opening is closed, the Client does not need to bear any fees thereof. As such, under most circumstances, this Agreement does not need to be terminated.
16.2. If needed, CoolJobz and the Client both has the right to unilaterally terminate the Agreement. If a party desires to terminate the Agreement, it has to inform the other party within a month prior to the expiration date. The parties may terminate the Agreement after performing all obligations under this Agreement.
16.3. All obligations under the preceding section include all payment, provision of information and information closure.
16.4. In the event of force majeure events, if either party cannot perform the agreement due to disasters, political events, religion, racial and other conflicts, the party is not legally liable to the other party.
16.5. If CoolJobz has any revision to the Agreement, it will inform the Client through the system and recordable form. In the event the Client disagrees with the revised content, under the general circumstances, it only needs to cease to use CoolJobz services.
 
17. Governing Law and Dispute Resolution
17.1. Unless otherwise stipulated by laws and regulations, the Client and CoolJobz agree that any dispute arising from this Agreement and/or “services,” will be governed by the relevant laws and regulations of HONG KONG.
17.2. If the Agreement has any parts or terms that cannot be performed, the parties both agree that the terms of the Agreement shall be revised in a way feasible and consistent with the original ends. If the revision is impossible, the parties agree to remove those parts incapable of being performed, and perform the rest of the term in the Agreement.
17.3. Within the extent permissible by laws, both the English version and the Traditional Chinese version are legally binding and other translations are only for the convenience of understanding. In the event there is any discrepancy in the clauses and terms between the different versions, then the English version shall prevail. This Agreement is the final and complete consent of the parties and replaces any oral or written promises, understanding or other expresses submitted during the negotiation. The title of terms of this Agreement is only for reference, the parties agree that the title may not be used as the basis of interpretation.
17.4. If CoolJobz does not take legal actions for breaches, it does not mean that CoolJobz waive the right to perform this Agreement. Client may not assign or transfer this Agreement (or membership or use of service) without the consent of CoolJobz. However, the Client agrees that CoolJobz may assign this Agreement to relevant institutes or institutes purchases CoolJobz.
17.5. You agree that the address specified in Article 24 will be the only way to provide CoolJobz a legal notice.
